OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Consequential Damages Exclusion

Under no circumstances shall Dev Suite be liable for any consequential, incidental, indirect, special, or punitive damages, including but not limited to loss of business opportunity, reputation damage, or economic loss, even if we have been advised of the possibility of such damages.

Force Majeure

Dev Suite shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of nature, war, terrorism, riots, telecommunications failures, internet outages, strikes, or government actions.

5. Legal Information and Dispute Resolution

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, United States, without giving effect to any principles of conflicts of law.

Jurisdiction and Venue

You agree that any legal action or proceeding arising from these terms shall be brought exclusively in the state or federal courts located in King County, Washington. You consent to the personal jurisdiction of these courts.

Dispute Resolution Procedures

Before initiating any legal proceedings, you agree to first attempt to resolve disputes through good-faith negotiation. If negotiation fails within 30 days, disputes shall be resolved through binding arbitration in Seattle, Washington, under the rules of the American Arbitration Association.

Class Action Waiver

You agree to resolve disputes with Dev Suite on an individual basis and waive your right to participate in any class action, collective action, or representative proceeding.

Severability Clause

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations without restriction. Any attempted assignment in violation of this provision is void.

Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Dev Suite.

Dev Suite reserves the right to modify, amend, or update these Terms and Conditions at any time at our sole discretion. Material changes will be communicated through:
